By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you should not use the Services.
1. Eligibility
The Services are intended for use by:
- Parents and guardians,
- Children under parental supervision,
- Schools and educational institutions.
Parents or guardians are responsible for supervising children’s use of the Services and providing any required consent.
2. Educational Purpose
The Services are designed to provide educational content intended to support mathematical learning and skill development.
The Services are intended as supplementary educational tools and are not intended to replace formal classroom instruction or professional educational assessment.
3. Accounts
Certain features may require the creation of an account.
Users agree to:
- Provide accurate information,
- Maintain the confidentiality of account credentials,
- Accept responsibility for activities occurring under their accounts.
Parents are responsible for child accounts associated with their profiles.
4. Educational Content Disclaimer
While we strive to provide accurate and effective educational content:
- We do not guarantee specific educational outcomes,
- We do not warrant that use of the Services will improve academic performance,
- The Services should not be relied upon as the sole source of educational instruction.
Parents and educators remain responsible for educational decisions regarding children.
5. User Conduct
Users agree not to:
- Use the Services unlawfully,
- Interfere with the operation of the Services,
- Attempt unauthorized access to systems or accounts,
- Upload harmful or inappropriate content,
- Misrepresent identity or educational affiliation.
We may suspend or terminate accounts that violate these Terms.
6. Child Safety and Community Features
If the Services include multiplayer, classroom, messaging, or community features:
Users may not:
- Harass or bully others,
- Share personal contact information,
- Upload inappropriate content,
- Engage in conduct harmful to children.
We reserve the right to moderate content and restrict access to protect users.
7. Subscriptions and Payments
Certain features may require paid subscriptions.
Subscriptions:
- Automatically renew unless canceled through the applicable app marketplace,
- Are billed through Apple App Store or Google Play,
- May be canceled through the applicable platform settings.
Except where required by law, fees are non-refundable.
8. Intellectual Property
All software, educational content, graphics, characters, branding, and technology associated with the Services are owned by or licensed to Matharoo.
Users may not:
- Copy,
- Reproduce,
- Distribute,
- Modify,
- Reverse engineer,
- Commercially exploit
any portion of the Services without prior written consent.
9. User-Generated Content
If users create avatars, custom problems, classroom content, or other materials within the Services:
- Users retain ownership of their content,
- Users grant Matharoo a limited license to host, process, and display such content solely for operating the Services.
Users represent that they have the necessary rights to submit such content.
10. Privacy
Use of the Services is also governed by our Privacy Policy.
11. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis.
We disclaim warranties including:
- Merchantability,
- Fitness for a particular purpose,
- Non-infringement,
- Availability,
- Accuracy of educational content.
12. Limitation of Liability
To the fullest extent permitted by law, Matharoo shall not be liable for:
- Indirect or consequential damages,
- Loss of educational data,
- Academic outcomes,
- Service interruptions,
- Third-party actions.
Our total liability shall not exceed the amount paid by you for the Services during the previous 12 months.
13. Termination
We may suspend or terminate access to the Services if users violate these Terms or misuse the Services.
Users may discontinue use of the Services at any time.
14. Modifications
We may modify these Terms from time to time.
Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
15. Governing Law
Except for disputes that can be brought in small claims court, all disputes between you and us, including any dispute regarding this Agreement, shall be exclusively settled through binding arbitration through the American Arbitration Association (“AAA”) pursuant to the AAA’s then-current rules for commercial arbitration. Any such arbitration proceeding will be conducted solely in English.
These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles. If the arbitration in this section provision is found unenforceable or not to apply for a given dispute, then the proceeding must be brought exclusively in a court of Delaware jurisdiction.
